The Tour & Risks The Fitzroy Walking Tour is a relaxed 1.5 to 2-hour conversational walk through public streets and laneways. Like any outdoor activity, it carries inherent everyday risks including uneven pavement, cobblestones, steps, traffic proximity, weather elements, extended standing, and slips or trips. 2. WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not in accordance with the statutory guarantees outlined below. Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you are rendered with due care and skill; are reasonably fit for any purpose which you make known to the supplier; and might reasonably be expected to achieve any result you have made known to the supplier. Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form. NOTE: The change to your rights does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence means doing or omitting to do an act with reckless disregard for the consequences. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2022 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012. 3. Your Agreement & Health By submitting this form, you participate voluntarily and accept the risks. You release and indemnify the Operator against claims for loss, injury, or damage arising from your participation (excepting cases of gross negligence). You confirm you are physically able to walk for up to two hours over uneven outdoor terrain and agree to inform the guide of any relevant mobility limitations prior to the tour. 4. Governing Law This document is governed by the laws of Victoria, Australia. Mandatory Waiver Agreement(Required) I am at least 18 years old. I’ve read and accept the Waiver, including how it impacts my rights under the Australian Consumer Law.
